MARIETTA, Ga. -- A judge ruled on Monday that she will not attempt charges that a Georgia guy accused in his son's warm auto passing had improper on-line exchanges with an under-age girl individually from murder charges against him. Claims that Harris had sexually-explicit online conversations using the under-age woman are totally unrelated to the murder and child cruelty charges he faces in the passing of his 22-month old son Cooper, protection lawyer Maddox Kilgore claimed Monday. But Cobb County Superior Court Judge Mary Staley dominated against him, agreeing with all the prosecution that these so-called activities provides evidence of a reason for the murder costs and certainly will show Harris' state-of thoughts leading up to as well as on the day of the boy's death.A detective testified that Justin Ross Harris advised girls he met online that he'd leave his wife if not for their son, reviews the Atlanta Journal Constitution.Cops have stated the boy was left in a sport utility vehicle for about seven hours on a day when temperatures in the atlanta-area attained at least into the large 80s. The medi cal examiner's office has mentioned the son died of hyperthermia - basically overheating - and called his death a murder. New information on the on-line chats surfaced Monday, including one that occurred within 1-5 minutes of the past time Harris noticed his son alive, reviews the newspaper. Staley on Monday stated the test will commence the week of Feb. 22.Harris was indicted in September 2014 on several charges, including malice murder, felony murder and cruelty to kids. The 8-count indictment also contains charges associated with accusations that Harris attempted to get an under-age woman to send him a picture of her genitalia, had sexually-explicit online conversations with her and sent her a sexually-explicit picture. Harris has pleaded not-guilty, and his attorneys have frequently mentioned the tot's death proved to be a terrible error."The state needs to bootstrap every terrible action they are able to think of to propose some grand strategy that does not exist," Kilgore stated as he claimed for a different trial on the sexting charges. Cobb County police Det. Phil Stoddard testified during the hearing that about the day his son died, Harris had several on-line and inperson relationships and traded messages with six girls, for instance, underage girl. There was signs Harris was miserable in his family existence and had mentioned if it were not for his son, he'd abandon his spouse, Stoddard testified under questioning by Assistant District Attorney Chuck Boring.Stoddard admitted when challenged by Kilgore that the under-age woman informed him that she understood Harris adored Cooper a lot, talked about how intelligent and good-looking he was and would never do something to harm him. The the lady also advised Stoddard that Harris stated he adored his wife and also would never abandon her. Even if most of the claims of dialogues and associations with other girls are authentic, which the defense disputes, that doesn't amount to some reason for homicide or show that Harris needed his son dead, Kilgore asserted. Dull countered that Harris had had several relationships both online and also in person, one or more of which was severe enough for him to inform a girl he adored her. Harris needed to be free of his household and free to pursue other associations, dull said. As the Harris sat together with his son in a fast food cafe the morning of the boy's departure, Harris replied to an anonymous post on the social networking stage Whisper when a person claims she is fed up with being married with children, Stoddard stated. Harris replied that he misses having time to himself and stated his spouse gets upset when he is out with friends."I love my son and all, but we equally want getaways," Harris wrote in his reply, Stoddard testified. Harris is a native of Tuscaloosa, Alabama, and moved to GA in 2012 to perform for residence Depot. Read Source
